الملخص
ملخص: ترتبط جريمة التزوير بوجود وثيقة بالمفهوم القانوني وجودا وعدما، وباعتبار أن شهادة التصديق الالكتروني هي الحل القانوني والتقني لمعضلة تحقق مبدأ الثقة والائتمان والاستقرار في المعاملات الالكترونية كونها تعمل على تأكيد هوية الأطراف وتحدد أهليتهم للتعامل الالكتروني وتضمن سلامة محتوى البيانات المتداولة مما يجعلها الأداة الفعالة التي يستنجد بها المتعامل الرقمي لاسترجاع حقوقه أمام القضاء يجعلها محلا لجريمة التزوير التي لا تقع أساسا إلا إذا كانت للوثيقة قيمة قانونية، ومنه يهدف هذا البحث إلى تسليط الضوء على مدى معالجة المشرع الجزائري لفعل تزوير شهادة التصديق الالكتروني وكيفية تعامله مع فكرة أن المحرر في جرائم التزوير التقليدية لا تلتقي مع فكرة المحرر الإلكتروني Abstract: The crime of forgery is linked to the existence of a document in the legal concept of existence and non-existence, and considering that the electronic certification certificate is the legal and technical solution to the dilemma of achieving the principle of trust, credit and stability in electronic transactions as it works to confirm the identity of the parties and determine their eligibility for electronic dealing It guarantees the integrity of the content of the data in circulation, making it the effective tool that the digital client seeks to recover his rights before the judiciary, making it the subject of the crime of forgery, which does not occur mainly unless the document has legal value, from which this research aims to shed light on the extent to which the Algerian legislator is treated.
