الرقابة القضائية على الصفقات العمومية كآلية لمكافحة الفساد المالي في الجزائر

الملخص
الملخص: تتمحور هذه الدراسة حول ابراز دور الرقابة القضائية على الصفقات العمومية لمكافحة الفساد المالي في الجزائر، والتي منحها المشرع الجزائري كأصل عام للقاضي الاداري الذي يمارسها بثلاث اقضية تتمثل في قضاء المشروعية ، والقضاء الكامل و القضاء الاستعجالي ،ومنحها كمبدأ استثنائي للقاضي الجزائي في شق جرائم الصفقات العمومية التي تأكد منذ صدور الامر 06-01 المتعلق بالوقاية من الفساد و مكافحته . ويرجع هدف المشرع من ازدواجية القضاء في هذا المجال لخاصية الصفقة العمومية كأداة قانونية تمول من ميزانية الدولة لتنفيذ البرامج التنموية ،ما يؤدي الى اهدار المال العام في ظل منافسة غير مشروعة تستوجب تكثيف الرقابة القضائية كحد من الانتشار الرهيب لظاهرة الفساد المالي في هذا المجال . الكلمات المفتاحية: صفقة– منافسة - رقابة –فساد–رشوة – قضاء. Abstract: This study focuses on highlighting the role of judicial oversight on public transactions to combat financial corruption in Algeria, which was granted by the Algerian legislator as a general asset to the administrative judge who exercises it in three cases represented in the legality judiciary, the full judiciary and the urgent judiciary, and granted it as an exceptional principle for the criminal judge in splitting the crimes of public deals that It has been confirmed since the issuance of Ordinance 06-01 related to the prevention and control of corruption. The legislator’s goal of the duplication of the judiciary in this field is due to the characteristic of the public deal as a legal tool financed by the state budget to implement development programs, which leads to wasting public money in light of illegal competition that requires intensifying judicial oversight as a limit to the terrible spread of the phenomenon of financial corruption in this field.
