اقرار الاختصاص القمعي لسلطة ضبط السمعي البصري في القانون الجزائري

الملخص
تعتبر سلطة ضبط السمعي البصري من سلطات الضبط المستقلة التي أوكل لها المشرع مهمة ضبط السوق الاعلامية الى جانب سلطة ضبط الصحافة المكتوبة ، خاصة وأن قطاع الاعلام اضحى من اهم القطاعات الاستثمارية ،الاقتصادية الاستراتيجية والحساسة المساهمة في عملية التنمية. ولقد منحها المشرع جملة من المهام للقيام بمهمة الضبط ،اهمها الاختصاص القمعي المتمثل في توقيع العقوبات الادارية على المتدخلين في القطاع تماشيا مع سياسة ازاحة السلطة العقابية للقاضي الجزائي لصالح السلطات الادارية المستقلة واستبدال العقوبات الجنائية بعقوبات ادارية في ظل صلاحيات محتشمة وفي غياب موقف دستوري صريح يحدد الاختصاصات القمعية لسلطات الضبط الاقتصادي بصفة عامة ، و سلطة ضبط السمعي البصري بصفة خاصة ،ما يترك فراغ مثير لإشكالية قانونية The audio-visual control authority is considered one of the independent control authorities that the legislator has entrusted with the task of controlling the media market, in addition to the authority to control the written press, especially since the media sector has become one of the most important investment, strategic and sensitive economic sectors contributing to the development process.
