الملخص
إن تشتت الظاهرة البيئية وتعدد أوجهها، يتطلب مشاركة واسعة بين الفواعل الوطنية في سبيل التكفل بها و حمايتها، لذلك كان لزاما على المشرع إشراك البلدية ولو بصفة تدريجية كفاعل محوري لحماية البيئة، بل وكلفها بمجموعة من الصلاحيات الواسعة في هذا المجال، كما زودها بمجموعة من الآليات القانونية لتحقيق أهدافها البيئية، والتي يعد الترخيص الإداري البيئي من أهمها، كوسيلة قانونية تقليدية، بأهداف وقائية أي قبل وقوع الضرر البيئي. Abstract: The dispersion of the environmental phenomenon and its multiplicity of facets, requires a broad participation of the national actors in order to take care of it and to protect it, It was therefore necessary that the legislator associates the municipality, even if gradually, as a pivotal actor protection of the environment, because it is the basic regional unit of the State, Yet it has entrusted it with a wide range of powers in this area. It has also provided it with a set of legal mechanisms to achieve its environmental objectives, of which environmental administrative authorization is one of the most important, as a traditional legal method, with preventive objectives, that is, before that environmental damage does not occur.
