الملخص
لمجلس الدولة أهمية كبيرة في ضمان الحصول على تشريعات ذات جودة، ويرتبط مدى تحقيق هذه النتيجة بمدى اتساع او ضيق مجال تدخله، وإن كان المؤسس الدستوري الجزائري قد ساير ما ذهبت إليه العديد من الدول بإنشائه مجلسا للدولة يقوم إلى جانب مهامه القضائية بمهمة استشارية، إلا أنه لم يسر على خطاها، فحصر المهمة الاستشارية لمجلس الدولة في دستور 1996 في ابداء الرأي في مشاريع القوانين، وبدستور 2016 أضاف له الاختصاص بإبداء الرأي في مشاريع الأوامر، مستثنيا مقترحات القوانين والمراسيم والقرارات الإدارية، التي تشكل أيضا إحدى أهم لبنات المنظومة القانونية في الجزائر.
