التدابير الوقائية من عصابات الأحياء على ضوء الأمر20-03

الملخص
تشكل عصابات الأحياء تهديدا خطيرا لأمن وسلامة الأفراد بهدف خلق جو من الرعب وعدم الاستقرار داخل الأحياء السكنية، أو بفرض السيطرة عليها من خلال الاعتداء المعنوي أو الجسدي على الغير أو تعريض حياتهم أو حريتهم أو أمنهم للخطر أو المساس بممتلكاتهم. حيث تصدى المشرع الجزائري لهذه الظاهرة عن طريق اصدار الأمر 20-03 الصادر في أوت 2020 يتعلق بالوقاية من عصابات الأحياء ومكافحتها. تهدف هذه الدراسة إلى التعرف على مضمون الآليات الوقائية من عصابات الأحياء، حيث استعملت المنهجين الوصفي والتحليلي للوصول إلى تفسيرات منطقية لهذه الظاهرة، وتحليل مضمون الأحكام والقواعد القانونية التي تحكم الوقاية من عصابات الأحياء ومكافحتها. وخلصت هذه الدراسة إلى ضرورة التطبيق الصارم لأحكام الأمر 20-03 واتباع سياسة اقتصادية ناجعة للقضاء على البطالة، وكذا توفير تغطية أمنية شاملة داخل الأحياء السكنية ضمانا لعدم انتشار هذه الظاهرة. Abstract: The neighbourhood gangs pose a serious threat to the security and safety of individuals and creating an atmosphere of terror and instability within residential neighbourhoods or by imposing control over them through moral or physical abuse of others or endangerment of others' lives, liberty or security, while the Algerian legislature's response to this phenomenon by issuing Order 20-03 of August 2020 relates to prevention and control of neighbourhood gangs, this study aims to identify the content of preventive mechanisms from neighbourhood gangs, where as it used a descriptive and analytical methodologies to arrive at logical explanations and analysis to this content of legal provisions and rules governing the prevention and control of neighbourhood gangs. To sum up we should apply entirly this order and follow an effective economic policy to eliminate jobless, and providing comprehensive security coverage within neighbourhouds to ensure that it won’t widespread once again.
