الاثبات الجنائي بالادلة العلمية

الملخص
يعد الاثبات من المواضيع البالغة الاهمية في المواد الجزائية حيث يرتبط بالجهد المبذول من قبل الجهات المختصة من اجل بلوغ الحقيقة والكشف عن ملابسات الجريمة. لقد ساهم التطور العلمي والتكنولوجي في بروز صور جديدة من الجرائم التي يصعب اثباتها بالنمط التقليدي، الامر الذي استدعى اللجوء الى الاثبات الجنائي بالأدلة العلمية كوسيلة للكشف عنها ورصدها مهما بلغت ذروتها وتطوراتها ومحاولات محو اثارها. يثير الموضوع مسألة في غاية الاهمية تتعلق بدور الأدلة العلمية في تكوين اقتناع القاضي، ذلك ان المبدأ يقرر بجواز الاثبات بكافة الوسائل وللقاضي ان يصدر حكمه تبعا لاقتناعه الخاص. The issue of evidence is one of the most important topics in criminal matters, as it is related to the effort made by the competent authorities in order to reach the truth and reveal the circumstances of the crime. Scientific and technological development has contributed to the emergence of new forms of crimes that are difficult to prove in the traditional manner, which necessitated resorting to criminal proof with scientific evidence as a means to detect and monitor them, no matter how high their climax, developments and attempts to erase their traces. The issue raises a very important issue related to the role of scientific evidence in forming the judge’s conviction, because the principle decides that proof is permissible by all means, and the judge has the right to issue his judgment according to his own conviction.
