آليات التكفل وإعادة الإدماج الاجتماعي للمساجين الأحداث وفق النصوص القانونية-دراسة نظرية تحليلية –

الملخص

ملخص: تهدف هذه الدراسة لمعرفة مفهوم المؤسسات العقابية في الجزائر ، أشكالها وأهم المشكلات التي يعاني منها السجين الحدث. خاصة ما يعاني منه الحدث بعد خروجه من السجن من عدم تقبل المجتمع وكذلك العجز المادي، كما من الممكن أن يتعرض للمراقبة المستمرة من الشرطة مما يسبب له الضغط النفسي و الاجتماعي. لذلك كان لابد من أن تلعب المؤسسات العقابية دور كبير في مساعدته لدمجه اجتماعيا نفسيا و تربويا من خلال مجموعة من الآليات تتماشى مع النصوص القانونية و تضمن له التوافق النفسو اجتماعي في نفس الوقت نذكر منها : -تكفل نفسي: من خلال توفير الدعم النفسي وتمحيص دقيق لمسببات الانحراف ودوافعه والتأهيل النفسي للحدث المسجون حتى نضمن له التوازن النفسي و الانفعالي الذي يضمن عدم عودة الحدث للانحراف. - تكفل اجتماعي: من خلال تركيز الجهود على السجين كفرد وتزويده بكافة الأسلحة المعنوية والمهنية الكفيلة بنجاحه في الحياة. تحويل السجن من مكان للكبت والحرمان وجعله مؤسسة ذات أهداف تربوية وعلاجية من خلال مختلف الأنشطة الترفيهية والدينية والثقافية . استغلال جميع الإمكانيات داخل السجن وخارجه لتحقيق التكيف الاجتماعي للسجين الحدث داخل السجن وخارجه بعد الإفراج عنه. -تكفل تربوي:من خلال تحسين المستوى الثقافي و العلمي للحدث المسجون من خلال النشاطات العلمية و الذي يضمن له فيما بعض الدمج المهني . Abstract: This study aims to know the concept of penal institutions in Algeria, their forms and the most important problems experienced by a young prisoner. Especially what the juvenile suffers from after his release from prison from the lack of community acceptance as well as the physical disability, as it may be subject to constant monitoring by the police, which causes him psychological and social pressure. Therefore, it was necessary for the penal institutions to play a large role in helping to integrate it socially, psychologically and educationally, through a set of mechanisms that are in line with the legal texts and guarantee it psychosocial compatibility at the same time, we mention : - Psychological guarantee: By providing psychological support, careful scrutiny of the causes of the deviation and its motives, and the psychological rehabilitation of the imprisoned juvenile, in order to guarantee him the psychological and emotional balance that ensures that the juvenile does not return to deviation. Social Security: By focusing efforts on the prisoner as an individual and providing him with all the moral and professional weapons necessary for his success in life. Transforming the prison from a place of suppression and deprivation and making it an institution with educational and therapeutic goals through various recreational, religious and cultural activities. Exploiting all possibilities inside and outside the prison to achieve the social adaptation of the juvenile prison inside and outside the prison after his release Educational guarantee: By improving the cultural and scientific level of the imprisoned juvenile through scientific activities, which guarantees him some professional integration.
