فعالية رخصة البناء في تطبيق التصوّرات البيئية لمخططات التعمير المحلية

الملخص
تحتلّ رخصة البناء مكانة هامة في المنظومة القانونية للتعمير في الجزائر، فقد حظيت هذه الأداة باهتمام المشرّع الجزائري منذ تاريخ الإستقلال، إذ تعتبر الوسيلة القانونية الأولى التي تستند إليها سلطات الضبط الإداري في تنظيم المجال الحضري ورقابة النّشاط العمرانـي، وقد تطوّر دورها ليمتدّ إلى حماية البيئة بعدما شكّلت هذه الأخيرة بعدأ هاماً من أبعاد سياسات التعمير، لتصبح بذلك وسيلة حماية. تهدف هذه الدّراسة إلى بحث فعالية رخصة البناء في تطبيق التصوّرات البيئية لمخططات التعمير المحلّية، فهذه الأخيرة تعتبر بمثابة السياسة العمرانية المحلّية بالنسبة للبلديات، تضمن من خلالها التحكّم في آفاق التوسّع العمرانـي المستقبلي للمدن، تحسين وتأهيل المناطق والأنسجة العمرانية القديمة، الوقاية من المخاطر الطبيعية والتكنولوجية، حماية البيئة وحفظ الموارد الطبيعية، فرخصة البناء هي الأداة المثلى لترجمة تصوّرات وتوجيهات التخطيط العمرانـي ونقلها من حيّز التنظير إلى الواقع العملي، غير أنّ دورها في تطبيق التصوّرات البيئية لا يكتمل إلاّ إذا بُني نظامها القانونـي على أسس ملائمة لفكرة حماية البيئة. The building permit occupies an important place in the urban legal system in Algeria. This tool has received increased attention of the Algerian legislator since the date of independence, as it is the first legal means on which the administrative control authorities rely in regulating the urban field and controlling urban activity, Its role has evolved to extend to protecting the environment after The latter constituted an important dimension of the urban policies, thus building permit becoming a means of protection. This study aims to identify the effectiveness of the building permit in applying the environmental perceptions of the local urban development plans. These plans are considered as the local urban policy for the municipalities, through which they guarantee control over the prospects of future urban expansion of cities, improvement and rehabilitation of old urban areas, prevention of natural and technological risks, protection of the environment and preservation of natural resources, so the building permit is the ideal tool for translating urban planning visions and directives from theorizing to practical reality. However, its role in implementing environmental perceptions is not complete unless its legal system is built on appropriate foundations for the idea of environmental protection.
