الحماية القضائية للبيئة في إطار دعوى إلغاء مخططات التعمير

الملخص
كرّس المشرّع الجزائري مبدأ حماية البيئة في قانون التعمير مسايراً بذلك الحركة البيئية العالمية، وتعمل السلطات المحلّية المتمثّلة في البلديات على إدماج الانشغالات البيئية في مجال التخطيط العمراني، أين يتمّ إعداد المخططات التوجيهية للتهيئة والتعمير ومخططات شغل الأراضي على ضوء الأهداف البيئية لقانون التعمير والقوانين المنظّمة لسياسة التسيير المجالي والتهيئة الإقليمية، وبما أنّ هذه المخططات تعتبر قرارات إدارية تنظيمية فإنّها قد تكون محل رقابة قضائية في إطار دعاوي فحص المشروعية أو دعاوي الإلغاء، وتكتسي هذه الأخيرة أهمية كبرى في مجال الرّقابة على مدى مراعاة واحترام الأبعاد البيئية في هذه المخططات وفق ما تقتضيه قواعد المشروعية. تهدف هذه الدراسة إلى إلقاء الضوء على طبيعة الحماية القضائية للبيئة في إطار دعوى الإلغاء عندما تنصبّ على مخططات التعمير، وكذا تبيان مدى أهميتّها كضمانة من الضمانات القانونية في إرساء مبدأ الإدماج البيئي المكرّس في قانون التعمير وقوانين حماية البيئة. The Algerian legislator has enshrining the principle of environmental in the town planning law, in line with the international environmental movement. The local authorities work to integrate environmental preoccupations in the field of urban planning, where the urban development plans should be prepared in the light of environmental objectives that affirmed in the urban laws. And since these plans are considered as regulation administrative decisions, they may be subject to judicial control within framework of the legality examination lawsuits or cancellation action, This latter has a great importance in the field of oversight of the extent to which environmental dimensions are respected in these plans, in accordance with the requirements of legality principle. This study aims to shed light on the nature of judicial protection of the environment in the framework of the cancellation lawsuit when it instated on urban development plans, and to show its importance as one of the legal guarantees in establishing the principle of environmental protection affirmed in town planning law and the environmental laws.
