الحماية الدولية للحرية الدينية بين القصور الدولي واختلاف الاديان

الملخص
ممارسة الشعائر الدينية هو الحق في حرية الوجدان والضمير في كل ما يتوصل اليه الانسان من اختيار عن طريق اجتهاده في فهم الدين دون اكراه ، لذا تعتبر الحرية الدينية من المواضيع التي اثارت الكثير من النقاشات والتحديات في العصور الغابرة، والكثير من الحبر في عصرنا المعاصر والتي لا تزال محل اختلافات، بسبب تعرض هذا الحق الى معوقات كثيرة عبر مختلف مراحل التاريخ، الى ان وجد مكانته ضمن منظومة حقوق الانسان مثل الاعلان العالمي لحقوق الانسان و الاتفاقية الاوروبية لحقوق الانسان..الخ. لكن لايزال يعترض الحرية الدينية معوقات قانونية كعدم الزامية بعض النصوص القانونية الدولية، وعدم الادراك ان الشخص في ممارسته لحقه في الحرية الدينية لابد ان يلتزم بقوانين الدولة التي يعيش فيها، حتى لا يكون في ممارسته لتلك الحرية دون قيد اخلال منه بالنظام العام والآداب العامة او ان يكون في ممارسته لها مساس بحرية الاخرين. The practice of religious rituals is the right to freedom of conscience and conscience in all that a person can choose through his diligence in understanding religion without coercion, so religious freedom is one of the topics that sparked many discussions and challenges in ancient times, and a lot of ink in our contemporary era that does not There are still differences, because this right was exposed to many obstacles throughout the various stages of history, until it found its place within the human rights system, such as the Universal Declaration of Human Rights and the European Convention on Human Rights ... etc. However, religious freedom still faces legal obstacles such as the non-compulsion of some international legal texts, and the failure to realize that a person in exercising his right to religious freedom must abide by the laws of the country in which he lives, so that in his exercise of that freedom without restriction, he does not violate public order and public morals or that It is in his exercise of it prejudice the freedom of others.
