مدى تكريس المشرع الجزائري للإلتزام بضمان السلامة في قانون الإستهلاك والنصوص التطبيقية له

الملخص
ملخص سعى المشرع الجزائري إلى وضع قواعد تضمن سلامة المستهلك من أضرار المنتوجات الصناعية المتطورة التي أضحت تهدد كيانه الجسدي وممتلكاته المادية. وتمثلت هذه القواعد في آليات وقائية أي إقرار عدة التزامات على عاتق المتدخلين، وآليات علاجية تمثلت في إقرار مسؤولية كل من ينتهك متطلبات السلامة. فالهدف المرجو من تفعيل هذه الآليات ،هو تحقيق الرغبة المشروعة التي يتوقعها المستهلك و تمكينه من الانتفاع بالمنتوجات والخدمات المطروحة في السوق بصورة آمنة تضمن له عدم المساس بسلامته ومصالحه المادية، هذا من جهة. ومن جهة أخرى هو إعادة التوازن بين أطراف العلاقة الاستهلاكية أي المتدخل صاحب النفوذ الاقتصادي لكونه يملك الوسائل المادية والخبرة الفنية بالمقارنة للمستهلك الذي يفتقر إليها. Abstract- The Algerian legislator sought to establish rules to ensure the safety of the consumer from the damage of advanced industrial products that have become threatening his physical entity and material property. These rules consisted in preventive mechanisms, that is to say the adoption of several obligations on the shoulders of the interventionists. And therapeutic mechanisms such as the recognition of the responsibility of all those who violate the requirements of safety.The aim of these mechanisms is to achieve the legitimate desire that the consumer expects and enable him to make safe use of the products and services offered in the market in a safe manner, ensuring that he does not compromise his safety and material reconciliation, on the one hand, and on the other hand, it is to rebalance the parties of the consumer relationship, that is to say the interventionist with economic influence, because he has the material means and technical expertise compared to the consumer, who lacks it.
