الملخص
ملخص يتمتع الأساتذة الباحثون بنظام قانوني أكثر حمائية مقارنة ببقية أسلاك الموظفين العموميين، يظهر خاصة على صعيد اتساع حرية التعبير المكفولة لهم عند ممارسة نشاطاتهم التعليمية أو البحثية، حيث يكون لهذه الحرية الأفضلية على واجبي الحياد والتحفظ. تتناول الدراسة النظام القانوني لحرية التعبير المقررة لهذه الفئة المهمة من موظفي الدولة، وذلك وفق مقاربة قانونية تتخذ من التساؤل حول مدى موازنة التنظيم القانوني لهذه الحرية بين متطلبي منح الأستاذ الباحث قدرا واسعا من حرية التعبير، وعدم تعسفه في استعمال هذه الحرية إشكالية لها. وقد خلصت الدراسة إلى تقرير كفاية هذا التنظيم القانوني إلى حد كبير في تحقيق المصالحة بين هذين المتطلبين الأساسيين. Résumé Les enseignants chercheurs bénéficient d'un régime juridique plus protecteur que les autres corps de la fonction publique, notamment en ce qui concerne l'étendue de la liberté d'expression qui leur est garantie lorsqu'ils exercent leurs activités d'enseignement ou de recherche. Cette liberté a la préférence sur les devoirs de neutralité et de réserve. La présente étude traite le régime juridique de la liberté d'expression établi pour cette catégorie de fonctionnaires publics, selon une approche juridique qui prend la question de savoir dans quelle mesure la réglementation juridique de cette liberté parvient à un équilibre entre les exigences d'octroi à l’enseignant chercheur d'une large liberté d'expression et l’usage non abusif de cette liberté de sa part, comme problématique. L'étude a conclu que cette réglementation juridique est suffisante pour parvenir à la conciliation entre ces deux exigences fondamentales. Abstract Researcher teachers benefit from a more protective legal regime than other public service bodies, in particular with regard to the extent of the freedom of expression guaranteed to them when they exercise their activities teaching or research. This freedom has preference over the duties of neutrality and reserve. This study focuses on the legal regime of freedom of expression established for this category of public officials, according to a legal approach which raises the question of to what extent the legal regulation of this freedom strikes a balance between the requirements of granting to the researcher of a broad freedom of expression and the non abusive use of this freedom as problematic. The study concluded that this legal regulation is sufficient to achieve reconciliation between these two fundamental requirements.
