الفحص الطبي قبل الزوج

الملخص
يتطلع أطراف العلاقة الزوجية إلى التمتع بالاستقرار والراحة، وتكوين أسرة ينعم أفرادها بالصحة والقوة والازدهار، وكل ذلك مرهون بمجموعة من العوامل المختلفة، من بينها وأهمها الصحة الجسدية والعقلية لطرفي العلاقة الزوجية. وقد حرصت التشريعات المقارنة على ايلاء هذه المسالة ما تستحقه من العناية، لتعلقها بالصحة العامة وسلامة المجتمع والأجيال المتعاقبة، حيث تبنت مبدأ الفحص الطبي قبل الزواج بصور وأشكال تنسجم مع ثقافة وفكر الأفراد المعنيين به . وقد حذا المشرع الجزائري حذوها، وذلك بموجب الأمر 05/02 الذي حاول من خلاله المشرع الأسري مواكبة المستجدات العصرية، ومن بينها موضوع بحثنا الذي خصص له المشرع المادة 7 مكرر من قانون الأسرة، كأول نص قانوني يدرج شرط ما أطلق عليه المشرع مصطلح الشهادة الطبية لكل المقبلين على الزواج. The parties to marital relationship aspire to enjoy stability and comfort and to form a healthy, strong and prosperous family, all subject to a variety of factors, including, most importantly, the physical and mental health of the parties to the marital relationship. Comparative legislation has ensured that this issue is given due attention, as it relates to public health and the safety of society and successive generations, adopting the principle of pre-marital medical examination in ways and forms consistent with the culture and thinking of the individuals concerned. The Algerian legislature followed this example by means of Order No. 05/02, in which the family legislator tried to keep pace with modern developments, including the subject of our research, to which the legislator devoted article 7 bis of the Family Code, as the first legal text to include the requirement of what the legislator calls a medical certificate for all those who enter into marriage.
