الملخص
الملخص: لا يحيد القاضي الاجتماعي ،و هو يحاول معرفة مدى وجود تعسف في الإقدام على قرار التعسف الذي يتخذه رب العمل، عما يستعمله القاضي المدني بخصوص التعسف في المسائل المدنية من حيث إعمال المبادئ و الوسائل الفقهية المعترف بقيمتها في تسهيل مهمة الوصول الى حكم قضائي عادل بين الطرفين ،مع بعض الفروق في المسائل الاجتماعية كعمومية وسائل الإثبات مقارنة بما هو مسموح به في المسائل المدنية ، و هو ما سندرسه في هدا البحث بالتطرق لوسائل القاضي الاجتماعي في معرفة مدى وجود التعسف في قرار التسريح . الكلمات المفتاحية: التعسف ،وسائل القاضي ، المسائل الاجتماعية ، رب العمل ،القاضي الاجتماعي. Abstract: The social judge does not deviate, while he is trying to find out the extent of the arbitrariness in taking this arbitrary decision. The employer takes it for what the civil judge uses regarding abuse in civil matters in terms of actions The jurisprudential principles and methods recognized for their value in facilitating the task of reaching a fair judicial judgment The two parties, with some differences in social matters such as general, means of proof compared to what is permissible In civil matters, which is what we will study in this research by dealing with the means of the social judge in knowledge The extent of arbitrariness in the dismissal decision.
