ملخص: تعتبر مسألة التكييف القانوني عملية ضرورية لمعرفة القواعد الواجبة التطبيق على عقد الاستهلاك، وهذا يستلزم تفسير إرادة الطرفين والبحث عن النصوص القانونية الواجبة التطبيق، وبما أن قواعد قانون حماية المستهلك قواعد آمرة تتعلق بالنظام العام لا يجوز للمتعاقدين مخالفتها أو الاتفاق على ما يخالفها، بالتالي يستوجب البحث أو التأكد من نية المقتني للمنتوج أو الخدمة، وما إذا كانت تتجه إلى اقتناء المنتوج للاستهلاك الشخصي النهائي المباشر أو يقصد تحقيق الربح عن طريق إعادة بيعه أو تصنيعه. الكلمات المفتاحية: المستهلك. المنتوج ؛ القرض الاستهلاكي؛ عقد التأمين؛ عقد البيع. Abstract: The issue of legal adaptation is considered a necessary process to know the rules applicable to the consumption contract, and this requires interpreting the will of the two parties and searching for the applicable legal texts, and since the rules of the Consumer Protection Law are peremptory rules related to public order, it is not permissible for the contracting parties to violate them or agree on what contradicts them, therefore it requires research. Or ascertain the intention of the purchaser of the product or service, and whether he intends to acquire the product for direct final personal consumption or whether he intends to make a profit by reselling or manufacturing it Keywords: consumer.
