الدراسة الاولية للمحكمة الجنائية الدولية في جرائم الاحتلال الإسرائيلي في فلسطين

الملخص
أمام الجرائم البشعة والانتهاكات الجسيمة لحقوق الإنسان المرتكبة في حق الشعب الفلسطيني الأعزل من قبل الكيان الصهيوني الغاصب التي استمرت على عقود، والتي شكلت انتهاكا فاضحا لمختلف الاتفاقيات والمواثيق الدولية الخاصة بحماية حقوق الانسان، تعالت الاصوات الدولية المنادية بضرورة محاكمة مجرمي الحرب الإسرائيليين، الأمر الذي شكل تحديا حقيقيا للمحكمة الجنائية الدولية، باعتبارها انشءت خصيصا من اجل محاكمة مرتكبي الجرائم الدولية ومعاقبتهم، خصوصا بعد انضمام دولة فلسطين إلى نظامها الأساسي، مما دفعها الى فتح دراسة أولية في الجرائم الإسرائيلية المرتكبة في الأراضي الفلسطينية المحتلة، التي انتهت بعد خمسة سنوات باستصدار المدعي العام قرار بشأن نطاق الاختصاص الاقليمي للمحكمة الجنائية الدولية على الاراضي الفلسطينية، الذي وافقت عليه الدائرة التمهيدية الاولى ليشمل الاراضي التي تحتلها اسرائيل منذ العام 1967. In the face of the heinous crimes and gross violations of human rights committed against the Palestinian people by the defenseless Zionist entity for decades, which constitute a flagrant violation of the various internationale convention and instruments for the protection of human rights, International voices calling for the need to bring Israeli war criminals To justice, which poses a real challenge to the International Criminal Court, as it was created specifically to try and punich the perpetrators of International crimes, especially after the accession of the state of Palestine to its statute. This led it to open a preliminary study of the Isralei crimes committed in the occupied Palestinian territories, that ended five years later with a decision by the Prosecutor on the scope of the International Criminal Court's territorial jurisdications over the Palestinian territorial, Approved by the first Pre-Trial chamber to include territories occupied by Israel since 1967.
