إشكالات الشهر المتعلقة بالترقيم العقاري وأثره في تثبيت الملكية العقارية الخاصة

الملخص
للمحافظة العقارية دور مهم من خلال الصلاحيات الممنوحة لها من طرف المشرع الجزائري بدءا بمهام المحافظ العقاري في عملية المسح العام للأراضي و مهام أخرى تتعلق بخصوص مسك السجل العقاري، باعتبار أن مصالح الحفظ العقاري تلعب فيها الدور الكبير في استكمال ما بقي من اجراءات تلبي عمليات المسح ، غير أنه قد ينجم عن عملية ترقيم العقارات اشكالات جراء تسجيل الملكية أو الحقوق العينية العقارية نتيجة لعدة أسباب و التي قد تتعلق بأصل ملكية العقار و صعوبة إسناد الملكية لمالكها الحقيقي ، لذلك فالمحافظ العقاري يجد صعوبة في تحديد العقارات المذكورة في السند ،هذه الوضعية تترك آثارا على الترقيم العقاري و بالتالي على حجية الدفتر العقاري . Land conservation plays an important role through the powers conferred on it by the Algerian legislator, starting with the functions of the land conservator as part of the general study of land and other tasks related to the maintenance of the land register, considering that the interests of real estate conservation play a major role in completing the remaining procedures for responding to surveys, however, the land book process can be problematic due to the registration of property or rights real estate in real estate, for several reasons that may be related to the ownership of the property and the difficulty of transferring the property to its owner, which makes it difficult to identify the property mentioned in the deposit.
