دور الشهر العقاري في إثبات الملكية العقارية في التشريع الجزائري

الملخص
إن ضبط وتطهير الأملاك العقارية يقتضى شهر التصرفات الواقعة بشأنها، وباعتبار أنظمة الشهر نوعان شهر شخصي وشهر عيني، اعتمد المشرع النظامين نظرا لعدة أسباب تاريخية وواقعية، وبعد سنة 1975 طبق نظام الشهر العيني الذي يعتمد أساسا على المسح العام للأراضي وتأسيس السجل العقاري، ويقتضى تطبيقه احترام قاعدتين هما: قاعدة الرسمية والشهر المسبق، مع مراعاة جملة من الشروط القانونية. ونظرا لأهمية هذا الإجراء وخصوصيته؛ يجب أن يكون تحت إشراف المحافظ العقاري، بالتنسيق مع العديد من الجهات خاصة إدارة المسح. وفي الأخير إذا تجسد نظام الشهر المعتمد واحترمت أحكامه، يحقق آثاره أي تسلم الوثائق والسندات التي تشهد بحقوق الأشخاص على العقارات الممسوحة والمثبتة للملكية العقارية. Afin de contrôler et purifier les propriétés immobilières le législateur algérien a requis la publicité des actes immobilières, par ailleurs on a deux types de publicité, personnelle et réelle, le législateur a adopté les deux systèmes pour plusieurs raisons historiques et réalistes, dès l’année 1975 le système de publicité réelle a été appliqué, il se base essentiellement sur le cadastre général d’immeubles, ainsi que l'établissement du livret foncier. Pour une application adéquate deux règles sont indispensables officialité et la publicité anticipée, et il a prévoyait un certain nombre de conditions, étant donné l'importance de cette procédure et sa spécificité il doit être supervisé par le conservateur foncier, et ce en coordination avec plusieurs corps, notamment le cadastre, enfin si le système de publicité foncière adopté a été bien incarné, et ses formalités ont été aussi respectées, le dit système mène a de bonnes résultats, et conséquemment les documents et titres seront remises aux personnes, justifiant leurs propriété immobilières. in order to control and cleanse the real property condition behaviors the Algerian legislature ordered to register properties in the real estate. There are two systems one personal and the other is real. The legislature adopted the two systems due to several historical and realistic reasons. After 1975, the legislator applied the real system which is basically a general survey of the land and the establishment of record real estate. In order to apply it, there must be two rules that are the availability of the official base and prior declaration of the estate with a number of conditions. Due to the importance of this procedure and its specificity it is under the supervision of real estate portfolios, in coordination with several private entities especially the survey management. Finally; if we adopt the real system and respect its provisions; it will achieve its aims. Owners of the estate will receive the documentation and the bonds which are witnessing the rights of the property which is installed on the scanned Property real estate property.
