إشكالية عجز مستأجرين المحلات التجارية عن تنفيذ التزامهم بدفع مبلغ الإيجار بسبب جائحة كورونا كوفيد 19

الملخص
الملخص: يعتبر عقد الإيجار من أهم العقود المتداولة والأكثر انتشارا في حياة الأفراد والمجتمعات خاصة أن له دور كبير في التنمية الاقتصادية، كما يكتسب مكانة هامة بين باقي العقود الأخرى خاصة أنه يمكن المالكين من استغلال عقاراتهم بتأجيرها مع الحفاظ على خصوصية بقاء العين المؤجرة في يد مالكها وذلك بانتقال حق الانتفاع فقط للغير خلال مدة محددة. غير أنه نظرا لتفشي جائحة "فيروس كورونا كوفيد 19" ألزمت الدول على إتباع إجراءات استثنائية، فأغلب الدول اتخذت تدابير احترازية للحد من آثار هذا الفيروس، فالكثير من المستأجرين وجدوا أنفسهم عاجزين عن تنفيذ التزامهم بدفع الإيجار خاصة مع توقف عملهم حيث نجد أغلب المحلات التجارية في حالة ركود ما يرشح وقوع أزمة اقتصادية، وسط دعوة من هؤلاء لإيجاد حل لهم. Abstract: The lease contract is considered one of the most important circulating contracts and the most prevalent in the lives of individuals and societies, especially that it has a major role in economic development, and it also gains an important position among the other contracts, especially that it enables owners to use their properties by renting them while preserving the privacy of the leased property in the hands of its owner by transferring The right to use only for others during a specified period. However, due to the outbreak of the Corona Virus Covid 19 pandemic, countries are obligated to take exceptional measures, as most countries have taken precautionary measures to limit the effects of this virus. Many tenants found themselves unable to implement their obligation to pay the rent, especially as their work stops, where we find most shops in a recession that filters out an economic crisis, with an appeal from these to find a solution for them.
