خصوصية المصنف الرقمي عبر الأنترنت

الملخص
لقد عالجت هذه الدراسة موضوع خصوصية المصنف الرقمي عبر الأنترنت، ذلك أن تطور المصنفات الفكرية بفعل التطور التكنولوجي واتساع الهائل للشبكة الرقمية أدى إلى ظهور المصنفات الرقمية كرست لها حماية بموجب قانون حق المؤلف، وفي هذا تأثير بشكل واضح بالبيئة التكنولوجية، غير أن هذه المصنفات الرقمية لا توجد قواعد قانونية خاصة تنظمها مما يستوجب تطبيق القواعد التقليدية لحقوق المؤلف على هذه المصنفات الفكرية في العالم الإفتراضي، وقد تم طرح إشكالية مفادها هل أن هذه المصنفات الرقمية هي نوع جديد من المصنفات لها مركز قانوني مختلف عن المصنفات التقليدية؟ وما مدى ملائمة النصوص التقليدية في حماية هذه المصنفات المنشورة عبر الأنترنت؟ حيث تم تقسيم هذا الموضوع وفق مبحثين وذلك من خلال تحديد مفهوم المصنفات الرقمية وكذا كيفية حمايتها. Abstract: This study has dealt with the issue of the privacy of the digital work over the Internet, as the development of intellectual works due to technological development and the enormous expansion of the digital network led to the emergence of digital works devoted to protection under copyright law, and this clearly affected the technological environment, but these digital works do not There are special legal rules regulating them, which necessitate the application of the traditional rules of copyright to these intellectual works in the virtual world, and a problem has been raised that these digital works are a new type of works that have a legal status different from traditional works? What is the appropriateness of traditional texts in protecting these works published on the Internet? Where this topic was divided according to two sections, by defining the concept of digital works, as well as how to protect them.
