الارتقاء بالدور التشريعي لمجلس الأمة على ضوء التعديل الدستوري لـ 2016 ـ دراسة تحليلية لنص المادة 136ـ

الملخص
ملخص: يعتبر التعديل الدستوري الأخير لـ 6 مارس 2016 أول تعديل دستوري يعزّز من الدور التشريعي لمجلس الأمة من خلال منحه لأول مرة وبمقتضى نص المادة 136 منه حق المبادرة بالقوانين، بعدما كانت النصوص الدستورية سابقا لا تساوي بين غرفتي البرلمان، لا سيما على مستوى مرحلة المبادرة بالقوانين التي ظلت محصورة فقط منذ 1996 أي منذ تكريسها في أعضاء الغرفة الأولى، وهي النقطة المحورية التي شكلت أساس إشكاليتنا المتمثلة في كيفية مساهمة التعديل الدستوري لـسنة 2016 في تعزيز الدور التشريعي لمجلس الأمة ولأول مرة على مستوى مرحلة المبادرة، والتي ستعالج ضمن محاور أساسية ثلاث، ابتداء من تحديد دوره الغائب في عملية المبادرة بالقوانين قبل 2016، فإشراكه على ضوء هذا الأخير في هذه العملية التي يبدو أنها ظلت محتشمة، ما يقلّل من فعالية العمل التشريعي لمجلس الأمة على مستوى مرحلة أساسية تشكل أساس صناعة القانون. Abstract : The last constitutional amendment of March 6, 2016 is the first constitutional amendment that strengthens the legislative role of the National Assembly by granting it for the first time and according to the text of Article 136 thereof the right to initiate laws, after the previous constitutional texts were not equal between the two chambers of Parliament, especially at the level of the initiative stage of laws that It has been confined only since 1996, that is, since its dedication to the members of the first chamber, which is the focal point that formed the basis of our problem of how the constitutional amendment of 2016 contributed to strengthening the legislative role of the National Assembly for the first time at the level of the initiative phase, which will be dealt with within three basic axes. Identify the absent role in initiating the process of laws before 2016, so his involvement in light of the latter in this process that appears to have been modest, which reduces the effectiveness of the legislative work of the National Assembly at the level of an essential stage that forms the basis of law-making.
