أساس المسؤولية المدنية للمحكم في إطار تسوية منازعات التجارة الدولية - دراسة مقارنة-

الملخص
على قدر أهمية الدور الذي يلعبه المحكم في عملية التحكيم كونه عصبها و هو من يديرها ، و الحرية التي يتمتع بها في ظل هذا النظام ، فإنه قد يقع تحت طائلة المسؤولية المدنية أتجاه أطراف النزاع عن أخطائه التي يرتكبها أثناء تأذيته لمهمته التحكيمية. فإذا كان المحكم يتمتع بالحصانة بحكم الطابع القضائي للمهمة التي يقوم بها ، فإن ذلك لا يعني أنه يتمتع بها بصفة مطلقة ، بل لا بد من مساءلته مدنيا متى سبب بخطئه ضررا جسيما لأحد أطراف النزاع. فعلى الرغم من وجاهية الأسس التي ساقها الفقه من أجل أن تبنى عليها المسؤولية المدنية للمحكم ، فمازالت هناك العديد من الصعوبات التي تحيط بجوانب عديدة حول أساس هذه المسؤولية ، و هو ما جعل إقرار هذه المسؤولية لا يتم إلا في أضيق الحدود الضرورية التي تستلزم إقرارها. الكلمات المفتاحية: التحكيم التجاري الدولي ، المحكم ، أطراف النزاع ، الأخطاء التحكيمية ،المسؤولية المدنية . Abstract: Despite the fact that arbitrators play a pivotal role in the arbitration process which gives them significant freedom and flexibility when performing their tasks, they are still subject to civil liability in a dispute arbitration towards the parties in conflict in the event of serious errors. Presumed to be exempt from liability, arbitrators enjoy immunity given the nature of their role. However, this immunity is not absolute and they should be held responsible and accountable for any event of unlawful intent or gross negligence affecting the parties to the conflict. Even though the fundamentals and principles set by the system of Jurisprudence were clear and they can form the basis for the arbitrator’s civil liability, there are still ambiguities surrounding the different aspects of this liability. For this reason, Arbitrators can only be held liable for their actions in very limited circumstances and for acts on omissions which are deemed avoidable on a reasonable lever.
