الأمن المعلوماتي والحماية الإجرائية للمعطيات الشخصية من خطر المعالجة غير المشروعة في ظل قانون 18-07

الملخص
ملخص: نظراً للتطورات الرهيبة التي عرفها العالم في مجال التكنولوجيا والمعلوماتية إزدادت ضرورة حماية الأشخاص في شتى المجالات خاصة ما تعلق بحماية المعطيات ذات الطابع الشخصي، فأوجب المشرع بموجب هذا القانون جملة من الضمانات من بينها أن لا تتم معالجة هذه المعطيات الشخصية إلا في إطار قانوني محدد مسبقاً بموجب القانون ، ناهيك عن ابتعاد هذه المعالجة للبيانات الشخصية عن المساس بحقوق الأشخاص، فيما أقر المشرع في إطار المجابهة -حين المساس من قبل الأشخاص بحرمة البيانات الشخصية- جزاءات مترتبة عند التعرض لهذه البيانات وبذلك يكون المشرع قد أسهم في مجال توسيع الحماية مسجلاً تطور نوعي في هذا المجال. فهذه الدراسة تبرز الجوانب الحمائية التي أقرها المشرع الجزائري ومدى ونجاعتها في توفير الحماية للمعطيات الشخصية. Abstract: In view of the terrible developments that the world has witnessed in the field of technology and information, the need to protect people in various fields has increased, especially with regard to the protection of personal data. Under this law, the legislator has required a number of guarantees, including that this personal data shall not be processed except within a legal framework pre-determined by the law that guarantees the person respect for his human dignity, private life, and public freedoms, not to mention that this processing of personal data shall not prejudice the rights, honor, and reputation of people. While the legislator, in the context of the confrontation - when people violate the sanctity of personal data - imposed penalties upon exposure to this data. Thus, the legislator has contributed to expanding protection, recording a qualitative development in this field. This study highlights the protective aspects approved by the Algerian legislator and the extent and effectiveness of them in providing protection for personal data
