جريمة التلاعب في نظام المعالجة الآلية للمعطيات في قانون العقوبات الجزائري (بطاقة الدفع الالكترونية نموذجا)

الملخص
إن التسليم بوجود جريمة التلاعب تضر بالمعطيات المعالجة آليا يفترض وجود نظام معلوماتي كمحرك ومشغل له، مهما كانت الوسيلة المستخدمة في ذلك، سواء كان الحاسوب أو أي وسيط معلوماتي آخر. و تعتبر بطاقة الدفع الإلكتروني من وسائل الدفع الإلكترونية، وهي وسيلة وفاء مستحدثة ذات تقنية تكنولوجية عالية، تتميز بسهولة التعامل بها، وكذا الحماية من مخاطر حمل النقود، ولكن قد تتعرض هذه البطاقة إلى الولوج والتلاعب بالنظام المعلوماتي الذي تعمل عليه، مما دفع بالمشرع الجزائي للتدخل بهدف حمايتها جزائيا. Recognizing the existence of the offense of altering automatically processed data presupposes the existence of an information system as engine and operator, regardless of the means used, whether it is a computer or any other information medium. The electronic payment card is considered one of the means of electronic payment, and it is an innovative high-tech payment method, characterized by its ease of use, as well as protection against the risks associated with the transport of money, but this card can be exposed to access and manipulation of the information system on which it operates, which prompted the criminal legislator to intervene in order to protect it criminally.
