ابن راشد القفصي المالكي وتعليل الأحكام الشرعيّة

الملخص
تناولت في هذا البحث التعريف بشخصية أبي عبد الله محمّد ابن راشد القفصي (736 هـ)، حيث تطرّقت لذكر مولده ونشأته وحياته العلميّة والعمليّة ومصنّفاته وثناء العلماء عليه، ثمّ بعد ذلك تطرقت إلى تعليل الأحكام الشرعيّة عند ابن راشد، فعرّفت التعليل ثمّ بيّنت أنّ ابن راشد من العلماء القائلين بالتعليل وأنّه جار في كلّ مسألة من مسائل الفقه، كما اهتمّ ابن راشد بالكشف عن مقاصد التشريع وإبراز أسراره في مقدّمة كلّ كتاب من كتب الفقه التي يتناولها في مصنّفاته الفقهيّة. وقد تأثّر ابن راشد في تنويهه بالمقاصد واهتمامه بالتّعليل تنظيراً وإعمالاً بشيوخه كأمثال القرافي وابن دقيق العيد وابن شاس وغيرهم، ثمّ ذكرت أمثلة التعليل العمليّة باستقراء بعض كتبه. وخلصت إلى أنّ ابن راشد يعتبر عالماً من علماء المقاصد وشخصيّة بارزة في الفقه المالكي، حيث ساهم في خدمته ونشره عن طريق التدريس والتصنيف. In this research, I dealt with the definition of the personality of Abu Abdullah Muhammad Ibn Rashid Al-Qafsi (736 AH), where I mentioned his birth, upbringing and his Scientific and practical life, his compilations, and the scholars’ praise for him, Thereafter, I touched on the reasoning of the legal rulings of Ibn Rashid.so i identified the reasoning. Then i showed that Ibn Rachid is one of the scholars who advocate reasoning, and that he is underway in every issue of jurisprudence also, Ibn Rashid was interested in revealing the purposes of legislation and highlighting its secrets in the introduction to each of the books of jurisprudence that he deals with in his jurisprudential works Ibn Rachid was affected in his mention of the purposes and his interest in reasoning, theorizing and implementing his sheikhs Like Al-Qarafi, Ibn Daqeeq Al-Eid and Ibn Chasse and others, then I mentioned examples of practical reasoning by induction some of his books. I concluded that Ibn Rashid is considered as one of the scholars of the purposes and a prominent figure in Maliki jurisprudence, where he contributed to its service and dissemination through teaching and Category.
