منهج الإمام القفصي الفقهي في كتابه الفائق

الملخص

ملخص: يتناول هذا البحث "منهج الإمام القفصي الفقهي في كتابه الفائق" من خلال التّعريف بالإمام القفصيّ وكتابه الفائق وبيان خصائص منهجه في التّأليف، ثمّ ملامح منهجه الفقهيّ بذكر مصادره الفقهيّة التي يعتمد عليها وكيفية الإحالة إليها والاستفادة منها، وعرضه للمصادر التّشريعية من قرآن وسنة وإجماع وقياس وعُرف، وكيفية الاستدلال بها والتّرجيح بينها، ثمّ بيان منهجه في عرض المذاهب الفقهية والتّرجيح بينها. وقد خلصت الدّراسة إلى أنّ الإمام القفصيّ كان من أبرز العلماء الذين اعتنوا بالفقه من الجانب النّظري والتّطبيقي، وأنّ كتابه الفائق من أهمّ المراجع في ذلك، وهو صاحب معرفة واسعة بالمذاهب الفقهيّة، مُلتزم بأصول مذهبه، وذو أمانة علمية وتوثيق سليم، وأدب علميّ، وخلق رفيع في تعامله مع المخالفين. Abstract : This research deals with “Imam al-Qafsi’s jurisprudential approach in his book al-Faiq” by introducing Imam al-Qafsi and his book al-Fā’iq and a statement of the characteristics of his approach to authorship, then the features of his jurisprudential approach by mentioning his jurisprudential sources on which he depends and how to refer to them and benefit from them, and his presentation of the legislative sources from the Qur’an, Sunnah, consensus, analogy and custom.And how to infer it and weight it between them, and then explain his method in presenting the schools of jurisprudence and weighting between them. The study concluded that Imam Al-Qafsi was one of the most prominent scholars who took care of jurisprudence from the theoretical and practical side, and that his book Al-Fa’iq is one of the most important references in this, and he has extensive knowledge of jurisprudential schools, committed to the principles of his doctrine, and has scientific honesty, sound documentation, scientific literature, and high morals.in dealing with violators.
