الملخص
يهدف موضوع اختصاص القاضي في البحث عن مضمون العقد إلى تسليط الضوء على كيفية ممارسة القاضي لمهامه وفقا للقانون، وذلك عن طريق منحه اختصاص تفسير العقد من أجل البحث عن الإرادة المشتركة للمتعاقدين، وإعطاء التكييف القانوني الصحيح من أجل تحديد القانون واجب التطبيق على هذا التصرف، بالإضافة إلى تحديد نطاق هذا الأخير بهدف معرفة الآثار القانونية المترتبة عنه. لنستنتج بأن المشرع الجزائري حاول من خلال منح هذه الاختصاصات إلى إيجاد نوع من العدالة بين المتعاقدين غايتها حماية الرابطة التعاقدية واستقرار المعاملات من جهة وتغيير اختصاص مهمة القاضي من كونه قاضي سلب إلى قاضي متدخل يخضع لرقابة المحكمة العليا في مسائل القانون. Abstract:The subject of the judge's competence in the search for the content of the contract aims to shed light on how the judge exercises his functions in accordance with the law, by granting him the competence to interpret the contract in order to search for the common will of the contracting parties, and to give the correct legal adaptation in order to determine the law applicable to this conduct, in addition to determining the scope of the latter in order to know the legal consequences of it, it follows from the statement that legislator tried, by granting these competencies, to create a kind of justice between the contracting parties aimed at protecting the contractual bond and the stability of transactions on the one hand and changing the competence of the judge's task from being a judge of deprivation to an intervening judge subject to the supervision of the Supreme Court in matters of law.
