الملخص

ملخص: من القواعد الأصولية المقاصدية العظيمة قاعدة سد الذرائع؛ فهي من سُبل استنباط الأحكام وتطبيقها على الواقع تطبيقا صحيحا يحول دون تحقق كثير من دوافع الفساد، وبالرغم من أنه قد نُقل الخلاف بين العلماء في الأخذ بهذه القاعدة، إلا أنه عند النظر تجد أن من الذرائع أيضا ما نُقل اتفاقهم على العمل به، فما الحد المختلف فيه في هذه القاعدة وما المتفق عليه؟ وما سبب الاختلاف في ذلك؟ وما المترتب عنه من فروع فقهية؟ وقد خلص البحث إلى أن اختلاف العلماء في الأخذ بقاعدة سد الذرائع اختلاف في تحقيق المناط تتعدد أسبابه بحسب اختلاف مدارك الفقهاء في تقدير المصلحة والمفسدة والموازنة بينهما، وقد كان لذلك أثر في الاختلاف في الفروع الفقهية المأثورة عن علماء المذاهب الأربعة. Abstract: One of the great intentional fundamentalist rules is the rule of blocking pretexts; it is one of the ways to derive judgments and apply them to reality in a correct application that prevents many of the motives for corruption from being realized, and although disagreement has been conveyed among scholars in adopting this rule, but when considering you find that one of the pretexts is also what conveyed their agreement to What's the difference in that And the consequent branches of jurisprudence The research concluded that the difference between the scholars in adopting the rule of closing the pretexts is different in achieving the areas for several reasons, according to the different perceptions of the jurists in assessing the interest and spoilage and balancing between them, and this has had an impact on the difference in the branches of jurisprudence from the scholars of the four madhhabs.
