انعكاس فعالية الخيار التمويلي على المساعي القانونية لعقود الاستثمار الدولية في تحقيق التنمية الاقتصادية

الملخص
ملخص: تعتبر عقود الاستثمار الدولية من أثر المواضيع القانونية التي تحتاج البحث والتحليل كونها تتميز بطبيعة قانونية خاصة منة حيث أطرافها وموضوعها وسبل فض النزاعات الناجمة عنها ثم أن القوانين الدولية والوطنية جعلتها من سبل تحقيق التنمية الاقتصادية. ومن أهم الإشكالات التي تواجهها هو التمويل نظرا لضخامتها وطول مدة تنفيذها ،فبين الحاجة للتمويل ومساعي التنمية الاقتصادية يكون اختيار المصدر التمويلي من أهم الجوانب التي تحتاج الدراسة، حيث نهدف من هذا البحث إلى تبيان صلة الوصل بين تحقيق التنمية الاقتصادية في إطار عقود الاستثمار الدولية والتمويل حيث توصلنا من خلال هذا البحث إلى كونه يضع الدولة المضيفة في زوايا المديونية أو تمويل مشاريع أجنبية تحول أرباحها نحو بلدها الأم وكخيار مثالي تمويل المشاريع بالعملة الصعبة من قبل المستثمر الأجنبي لوحده أو باعتماد كيانات قانونية جديدة في شكل عقد مشروع مشترك وانعكاس كل ذلك على الاقتصاد المحلي وميزان المدفوعات ومن ثم جدية الاستثمار وتحقيق التنمية الاقتصادية. Abstract: The international investment contacts are considered one of the most legal topics that need research and analysis as they are distinguished with special legal nature in terms of its parties and subjects and ways to resolve the conflicts resulting from itthen the national and international laws made it one the ways to achieve economic development that’s why it’s the most important problems that it faces funding due to its magnitude and long period. Between the need for financing and economic development endeavors the choice of financing sources is one of the most important aspects that we need to studyas this research aims to show the link between achieving economic development within the framework of international investment and financing contractswhere we have reached through this researchthat it places the host country in debt corners of financing projects her profits towards her mother country as an ideal option to finance projects in hard currency by the foreign investors alone or by adopting legal entities in the form of a joint venture contracts and the reflection of all this on the local economy and the balance of payments and then the seriousness of investment and economic development.
