الملخص
تعد طريقة التسيير المفوض من الطرق الخاصة الحديثة، حيث لم يتم تنظيمها في الجزائر بقانون قائم بذاته إلا مؤخرا، و نظرا لأهميتها الحيوية في ضمان معايير الجودة و النجاعة في تقديم الخدمة العمومية لاسيما على الصعيد المحلي، فقد باتت الطريقة المفضلة في تسيير العديد من المرافق العامة الاقتصادية المحلية. و رغم العديد من الدراسات الأكاديمية التي تناولت الكثير من جوانبها إلا أنه تبقى إشكالية تحديد مدلولها القانوني من أهم الإشكاليات التي تثار لأجل تحديد طبيعتها القانونية و أهم النتائج القانونية المترتبة على أطرافها، لذلك ستحاول هذه الدراسة الإجابة على هاته الإشكالية معتمدين أساسا على تحليل المرسوم التنفيذي رقم: 18/199 المؤرخ في: 02 أوت 2018، الذي حاول رسم أهم معالم طريقة التسيير المفوض للمرفق العام في الجزائر. The delegated management method is one of the private and modern methods, as it was not regulated in Algeria by a stand-alone law until recently, and due to its importance in ensuring standards of quality and efficiency in providing public service, especially at the local level, it has become the preferred method in running many economic public facilities Local. Despite many academic studies that dealt with many of its aspects, the problem of determining its legal meaning remains one of the most important problems that arise in order to determine its legal nature and the most important legal consequences of its parties, so this study will try to answer this problem relying mainly on the analysis of Executive Decree No. 18: / 199 dated: 02 August 2018, who attempted to lay down the most important features of the delegated management method for the public utility in Algeria.
