قاعدة العادة محكّمة وأثرها في فضّ النزاع بين الزوجين المادة 73 من قانون الأسرة الجزائري -نموذجا-

الملخص
تعدّ قاعدة العادة محّكمة من أهم القواعد الفقهية الكبرى، والتي تجمع العديد من الفروع والأحكام الفقهية المتناثرة هنا وهناك من جهة، ومن جهة أخرى فالقاعدة ساهمت في حلّ الكثير من النزاعات الواقعة في دنيا الناس، وفي مختلف مجالات حياتهم، ومنها النزاعات الواقعة بين الزوجين في فك الرابطة الزوجية، وتحديدا النزاع الواقع بين الزوجين في متاع البيت. يعتبر النزاع المتعلق بمتاع بيت الزوجية من أهم صور وآثار فك الرابطة الزوجية، والمشرع الجزائري نظم أحكامه في مادة واحدة ووحيدة وهي المادة 73 من قانون الأسرة الجزائري، غير أن هذه المادة تثير عدة إشكاليات وتساؤلات تحتاج إلى إجابة وإزالة الإبهام والغموض. تهدف هاته الدراسة والمتعلقة بالنزاع الواقع بين الرجل والمرأة في متاع البيت، الإجابة على الإشكاليات التي تثيرها المادة 73، وذلك من خلال بيان متى يمكن لنا وللقاضي الجزائري على وجه الخصوص استثمار قاعدة من قواعد الفقه الإسلامي، وهي قاعدة العادة محكّمة، وإسقاطها على المادة 73 من قانون الأسرة الجزائري. The rule of custom is one of the most important rules of jurisprudence, which brings together many branches of jurisprudence on the one hand, and on the other hand, the rule has contributed to resolving many conflicts that occur in the world of people and in various areas of their lives.
