دسترة حرية الاستثمار

الملخص
الملخص: الاتجاه إلى توسيع دائرة مجال الحقوق والحريات العامة في الدستور الجديد هو حمايتها من كل أشكال التعسف الإداري، لإعطاء ضمانات للمستثمرين سواء كانوا مواطنين يقيمون في الجزائر أو غير مقيمين، أو حتى الأجانب المقيمين في الجزائر أو في بلادهم لم يستثنهم الدستور الجديد من الحماية وهذا وفق كيفيات وآليات يحددها القانون والتنظيم. اتجاه المؤسس الدستوري إلى تبني فكرة الدسترة كأن بناء على أسباب جد موضوعية طرحت على الساحة الاقتصادية وحتى القانونية الشيء الذي تولد عنه حتما مجموعة من النتائج . لذلك ما هي النتائج التي تمخضت عن دسترة حرية الاستثمار؟ وخلصت الدراسة الى أن اتجاه المؤسس الدستوري إلى دسترة الحقوق والحريات وتوسيع دائرتها إلى حرية الاستثمار، هو حمايتها بتوسيع دور القضاء الدستوري والمتمثل في المحكمة الدستورية، من خلال رقابة دستورية القوانين والتنظيمات ومطابقتها للمبادئ المكرسة لحرية الاستثمار في الدستور، والنتائج المترتبة عن النطق بقرار الالغاء، تم التكفل بهذه الحرية في دساتير 1996، و2016، وتم التأكيد عليها في دستور 2020. Abstract: To reach the circle of the field of rights and public freedom in a new way is to protect it from all forms of Administrative Arbitrariness, to provide privileges to investors or even in Algeria or non-residents, or even foreigners residing in Algeria or in Their Countries, the new constitution did Not exclude them from protection. the study concluded that the constitutional founder’s tendency to constitutionalize rights and freedoms and expand its circle to freedom of investment, and protect it by expanding the role of the constitutional judiciary represented in the constitutional court, through monitoring the constitutionality of laws and regulations, and their conformity with the principles enshrined in the freedom of investment in the constitution, and the consequences of pronouncing a decision cancel. this freedom was guaranteed in the 1996 and 2016 constitutions, and was confirmed in the 2020 constitution.
