استراتيجية التحول الرقمي والحماية الجنائية للمرفق العام الجزائري

الملخص
جاء التحول الرقمي للمرفق العام ليسهل الحصول على الوثائق بأقل تكلفة وبجهد أقل في وقت سريع ، وقد لعب دور كبير في تحسين الخدمات المقدمة للمواطنين ، لكن الاعتماد على المنظومة المعلوماتية بشكل كلي قد يجعلنا في مواجهة العديد من المخاطر تمس بأمن المعلومات وسريتها، الشيء الذي يؤثر سلبيا على مصالح وخصوصية المنتفعين والمرافق العامة، ومنه نهدف من خلال هذه الدراسة إلى إبراز أهم مظاهر التحول الرقمي للمرفق العام الجزائري مع توضيح السياسة الجنائية المتبعة لحماية الأمن الرقمي للمرفق العام الالكتروني، من خلال استحداث أجهزة جديدة – القطب الجزائي والهيئة الوطنية للوقاية من الجرائم المتصلة بتكنولوجيات الاعلام والاتصال- وإصدار آليات قانونية مستحدثة أهمها التفتيش الافتراضي و الدليل الجنائي الرقمي الوسيلة الوحيدة والأساسية لإثبات الجرائم الرقمية، وأخيرا إجراء التسرب الالكتروني كآلية لمكافحة جرائم المرفق العام الالكتروني Abstract: The digital transformation of the Algerian Public Utility has played a major role in improving the services provided to citizens and facilitating access to documents at the lowest possible time and cost information system ", but the overall orientation and reliance on the information system may place us in the face of many risks that could compromise the confidentiality and security of authorized information, This adversely affects the interests and privacy of the beneficiaries and public utilities. Through this study, we aim to highlight the most important manifestations of the digital transformation of the Algerian Public Facility and to clarify the criminal policy used to protect the digital security of the electronic public facility. Through the development of new organs - the Penal Pole and the National Authority for the Prevention of Crimes Related to Information and Communication Technologies - and the issuance of updated legal mechanisms, the most important of which is virtual inspection and digital criminal guide as the only and fundamental means of establishing digital crime and finally, electronic leakage as a mechanism to combat cybercrime.
