حماية ضحايا الاتجار بالبشر على ضوء مستجدات القانون 23-04

الملخص
تمكن المشرع الجزائري في خطوة جد مهمة في إطار محاربته لجريمة الاتجار بالبشر، من سن أول قانون يتعلق بالوقاية من الاتجار بالبشر ومكافحته وهو القانون رقم 23/04 المؤرخ في 7 ماي 2023 الذي تضمن أحكاما مهمة جمعت بين سياسة تجريم الاتجار بالبشر والمعاقبة عليه وسياسية الوقاية من هذه الجريمة من جهة أخرى . ومن بين أهم مستجدات قانون 23/04 أنه أولى اهتماما كبيرا بموضوع ضحايا الاتجار بالبشر من خلال التعريف بهم وتحديد صور الاستغلال التي يتعرضون لها، كما خصص فصلين كاملين لموضوع حماية ومساعدة الضحايا خاصة ما تعلق بالحقوق المقررة لهم قانونا، وكذا تعزيز دور المجتمع المدني ومختلف الآليات الوطنية بغية إعادة إدماجهم في المجتمع. In a very important step in its fight against the crime of trafficking in human beings, the Algerian legislature was able to enact the first law on the prevention and control of trafficking in human beings, Law No. 23/04 of 7 May 2023, which contained important provisions that combined the policy of criminalizing and punishing trafficking in human beings with the policy of preventing such crime. One of the most important developments of Act No. 23/04 is that it devotes considerable attention to the subject of victims of trafficking in human beings by introducing them and identifying the forms of exploitation to which they are subjected. It also devotes two full chapters to the protection and assistance of victims, particularly with regard to their legal rights, as well as strengthening the role of civil society and various national mechanisms with a view to their reintegration into society.
