الملخص
ملخص : يعتبر الحق في المساعدات الإنسانية من أهم الحقوق التي كفلتها قواعد القانون الدولي، سواء في حالة السلم أو في حالة النزاعات المسلحة، كونه يهدف إلى حماية حق الإنسان في الحياة، وقد عرفت المساعدات الإنسانية تنظيما دوليا خاصا و ذلك بتحديد مفهومها وخصائصها و أساسها القانوني وتحديد القيود التي يستلزم على القائمين عليها احترامها وإعمالها لضمان مشروعيتها. يتم تقديم المساعدات الإنسانية بموافقة الدولة المعنية مع احترام مبادئ العمل الإنساني كمبدأ الإنسانية و عدم التمييز و الحياد، ولكن في حالة عدم موافقة الدولة على دخول عمليات الإغاثة الإنسانية إلى أراضيها بدون سبب جدي أو سند قانوني يمكن للأمم المتحدة التدخل عن طرق أجهزتها لإرغام الدولة بالموافقة على الإغاثة و التي تصل إلى حد استخدم القوة العسكرية كون أن حرمان المدنيين من الإغاثة الإنسانية المراد إيصالها إليهم يشكل تهديد للسلم و الأمن الدوليين. Abstract: The right to humanitarian assistance is one of the most important rights guaranteed by the rules of international law, whether in state of peace or in a situation of armed conflict, as it aims to protect the human right to life. Humanitarian assistance has defined a special international organization by defining its concept characteristics, legal basis, and defining restrictions which must be respected and implemented to ensure its legitimacy. Humanitarian assistance is provided with the consent of the concerned state while respecting the principles of humanitarian action such as the principle of humanity, non –discrimination and impartiality, but in the event that the state does not consent to the entey of humanitarian relief operations to its territory without a serious reason or legal basis, the United Nations can intervene through its agencies to compel the state to agree to Relief, which amounts to the use of military force, given that depriving civilians of the humanitarian relief intended to be delivered to them constitutes a threat international peace and security.
