الملخص
ملخص: عـقد الايجار من أكثر العقود تداولا بين الأشخاص وينصب على محلات مختلفة منقولة أو عقارية، ونحن سنختص بالحديث عن ايجار الأملاك العقارية الوقفية باعتبار الملك الوقفي حجر زاوية في تحقيق سبل التنمية ويظهر ذلك بصورة جلية إذا كان العقار محلا للتصرف الوقفي. إلا أن خضوع نظام الإيجار للأملاك العقارية الوقفية للقواعد العامة اصطدم بالقيد القانوني بموجب نص المادة 468 و469 من القانون المدني مما أدى بالأعيان الموقوفة إلى أن تنتهي عادة بأن تكون أراضي مخربة لا يكفي ريعها حتى لاستصلاحها أو الاستثمار فيها من أجل ذلك عرف قطاع الوقف محاولات تشريعية تستهدف استغلاله منها القانون 01-07 المعدل والمتمم الذي حاول فيه المشرع تفعيل المؤسسة الوقفية تحقيقا لدور التنمية وتجسد ذلك على وجه الخصوص في تنظيمه لجملة من العقود الاستغلالية وعلى رأسها عقد الحكر كصيغة للانتفاع بالأملاك الوقفية العاطلة وذلك عن طريق ايجارها لمدة طويلة. Abstract: The leasing contract is one of the most frequented contracts between persons; it focuses generally on various movable or real estate underlying. We will address the real estate endowments leasing, which is considered a cornerstone for development achievement; this is clearly demonstrated if the real estate is subject of endowment’s act. However, the endowment property leasing regime's compliance with the general rules has been subject to a legal limitation, under the terms of article 468 and 469 of the Civil Code, which leads to the subversion of the endowment properties whose proceeds become insufficient even to restore or to invest. For this purpose, several legislative attempts were made in order to reform the endowment sector, including the amended and completed law N° 01-07, in which the legislator tried to activate the endowment institution to achieve the role of development, in particular by introducing a series of exploitative contracts, notably the “Rule Contract” as a formula for using the unemployed endowment properties through a long- term leasing.
