التدابير التربوية كآلية بديلة للعقوبة في مجال قضاء الأحداث Educational Measures As An Alternative Mechanism For Punishment In The Field Of Juvenile Justice

الملخص
:الملخص ﺨﺼﺹ ﺍﻟﻤﺸﺭﻉ ﺍﻟﺠﺯﺍﺌﺭﻱ ﻗﺎﻨﻭﻨﺎ ﻤﺴﺘﻘﻼ ﻟﺤﻤﺎﻴﺔ ﺍﻟﻁﻔل، ﺘﻀﻤﻥ ﻤﺠﻤﻭﻋﺔ ﻤﻥ الإجراءات تصب في مصلحة الطفل بإعتباره الشريحة الضعيفة في المجتمع و الأولى بالحماية القانونية، و جعل المسؤولية الجزائية القائمة في حقه غير مكتملة نظرا ﻟـﻨﻘﺹ ﻗﺩﺭﺘـﻪ ﻋﻠـﻰ ﺍﻹﺩﺭﺍﻙ ﻭﺍﻟﺘﻤﻴﻴﺯ ﻭﻋﺩﻡ إكتمال ﻨﻤﻭﻩ ﺍﻟﻌﻘﻠﻲ ﻭ ﺍﻟﺠﺴﺩﻱ, كما ﻭﺍضع ﺃﺴﺴﺎ ﺠﺩﻴﺩﺓ ﻟﻠﻤﻌﺎﻤﻠﺔ ﺍﻟﺠﻨﺎﺌﻴﺔ ﻟﻠﻁﻔل ﺍﻟﺠﺎﻨﺢ تكفل له الحماية الإجتماعية و القضائية على حد سواء، و من خلال مجموع أحكامه نلمس توجه المشرع للحد من العقاب و ذلك بالحث على ضرورة تطبيق القاضي المختص بالبث في الجرائم المرتكبة من قبل الأحداث التدابير التربوية بدائة، و عدم اللجوء إلى تسليط العقوبات الجزائية إلا في حال فشل تلك التدابير من تحقيق الغاية المرجوة منها و المتمثلة في إصلاح الطفل الجانح وإعادة تأهيله، كما دعا إلى ضرورة ﺘﺠﻨﻴد ﺠﻤﻴﻊ ﻤؤﺴﺴﺎت اﻟدوﻟﺔ من أجل القضاء على ظاهرة جنوح الأحداث التي أصبحت تعرف رواجا في أوساط مجتمعنا،لأن المعاملة العقابية التقليدية لم تعد كافية لتحقيقها بل زادت من نسبة الإجرام و كله كان .في إطار دعم توجهات السياسة الجنائية المعاصرة المتعلقة بإعمال بدائل العقوبات. Abstract: The Algerian legislator allocates an independent law for child protection, which includes a set of measures that are in the interest of the child as the weak segment of society and the priority of legal protection. New foundations for the criminal treatment of the delinquent child that guarantees him both social and judicial protection, and through the sum of its provisions, we see the legislator’s tendency to reduce punishment by urging the need for the judge in charge of broadcasting in crimes committed by juveniles to apply educational measures initially,and not to resort to Imposing punitive penalties except in the event that these measures fail to achieve the desired goal of reforming and rehabilitating the delinquent child. It is no longer sufficient to achieve it ,but rather it increased the crime rate,all of which was within the framework of supporting contemporary criminal policy trends related to the implementation of alternatives to penalties.
