الملخص
الملخص: يقوم مبدأ المشاركة على شرط أساسي يتمثل في شفافية النشاط الإداري الذي يسمح للمجتمع المدني بأن يكون بمثابة جهاز رقابة على أعمال الإدارة وشريك في إتخاذ القرارات، لذلك يكتسي الإقرار الدستوري للحق في النفاذ إلى المعلومة الإدارية تطبيقاً لأحكام المادة 55 من دستور سنة 1996 أهمية كبيرة لإعمال حق المشاركة، باعتبار أنّ التكريس الدستوري لأي موضوع من المواضيع القانونية يعني الرفع من معايير إقراره ومشروعيته، وتجسيداً لهذا التوجه لابُد من وجود ضمانات فعالة لحماية هذا الحق يلجأ إليها الفرد للبت في شكواه أو إعتراضه في حالة عدم حصوله على المعلومات التي تعنيه. Abstract: The principle of participation is based on the fundamental requirement of transparent administrative activity, which allows civil society to play the role of monitoring body for the work of the administration and decision-making partner. Therefore, the constitutional recognition of the right of access to administrative information in accordance with the provisions of Article 55 of the 1996 Constitution is of great importance for the realization of the right. Participation, considering that the constitutional entrenchment of any of the subjects of law means the elevation of the standards of recognition and legitimacy, embodied by this trend, must constitute an effective guarantee to protect this right and allow the person to rule on its complaint or objection in the absence of access to the information it represents.
