مسؤولية المؤسسة الإستشفائية عن إستخدام الأشياء المعيبة في الجراحة التجميلية

الملخص
لقد إزدهرت الخدمات الطبية مقارنة مع الوسائل التكنولوجية المستعملة في المستشفيات بالاضافة إلى العاملين بالنشاط الطبي المباشر ذوي مهن طبية وصحية من جهة، والمواد والآلات والأجهزة الحديثة من جهة ثانية، حيث تستخدم هذه الأخيرة في الجراحة بصفة عامة والجراحة التجميلية بصفة خاصة، التي تساعد الجراح في إجراء الجراحة المزمع القيام بها وبدون هذه الأشياء لايستطيع جراح التجميل القيام بالعملية الجراحية، إذ قد يتعرض المريض إلى أضرار جسدية من جراء استعمالها، حيث تتطلب هذه الأشياء حراسة خاصة معها إذ أن التزام المستشفى وجراح التجميل هو التزام بعلاج المريض وليس بشفائه وهو التزام بتحقيق نتيجة أي لاتسوء حالته بسبب المستشفى ولايستطيع المستشفى التخلص من المسؤولية إلا بإثبات سبب أجنبي. Abstract: Medical services have flourished thanks to medical personnel, but also thanks to modern equipment and materials used in surgery, in general, and in aesthetic surgery, in particular In our age of digital modernization, the world has witnessed a fundamental change in the different domains of our lives, including the health sector. Indeed, the medical sciences are in rapid and permanent evolution, particularly under the effect of modern technology which blends with medicine that actually depends on, without which the surgeon cannot perform the operation, although the patient may incur bodily injuries due to the use of these means that require special attention. Although the obligation incumbent on the hospital and the surgeon is an obligation of means and not of result (healing), as long as the patient's condition does not deteriorate because of the medical activities he undergoes at the hospital; a liability that the hospital can only avoid by establishing a foreign cause. The study of the subject relating to legal liability for bodily injuries, due to defective items within the hospital, serves to determine the liable party, since the handling of most medical equipment requires specialized doctors and technical staff.
