الملخص
تعد المنشورات الإدارية أداة تستخدمها الإدارة لتوضيح القانون الساري المفعول من أجل تطبيقه من طرف موظفيها، غير أنها يمكن أن تتحول إلى سلاح خطير يمكن الإدارة من تقييد ممارسة الحقوق والحريات. لهذا نهدف من خلال هذه الورقة البحثية إلى تحديد طبيعة المنشورات الإدارية المقيدة لممارسة الحقوق والحريات الأساسية، وقد توصلنا إلى نتيجة مفادها أن المنشورات الإدارية الماسة بالحقوق والحريات الأساسية هي المنشورات الآمرة، والتي تكون إما منشور تنظيمي يضيق من الحقوق والحريات بإضافة قواعد جديدة ليست موجودة في الدستور أو القانون، أو منشور تفسيري آمر يفسر القواعد القانونية المنظمة لممارسة الحقوق والحريات تفسيرا واسعا أو ضيقا مع فرض الإلتزام به. Administrative circulars are a tool used by the Administration to clarify the applicable law for application by its staff, but they can become a dangerous weapon enabling it to restrict the exercise of rights and freedoms. Through this paper, we aim to identify the nature of administrative circulars that restrict the exercise of fundamental rights and freedoms. And we have come to the conclusion that administrative circulars that infringe upon fundamental rights and freedoms are jus cogens, which is either a regulatory circulars restricting rights and freedoms by adding new rules that do not exist in the Constitution or the law s rights and freedoms ", or an circular imperative interpretation the legal rules governing the exercise of rights and freedoms broadly or narrowly with the imposition of an obligation.
