توسيع سلطات القاضي الإداري لحماية الحقوق والحريات الأساسية

الملخص
لكل من القاضي العادي والقاضي الإداري أهمية كبيرة في حماية الحقوق والحريات الأساسية داخل المجتمع، لكن يبقى للقاضي الإداري دور أكثر فعالية لكونه يعمل على الإبقاء على التوازن الضروري بين حماية الأفراد من تعسف الإدارة وبين حماية النظام العام داخل المجتمع، من خلال توسيع مجال تدخل القاضي الإداري وتمكينه من صلاحيات أقوى، بحيث يتدخل بشكل منهجي وسريع من خلال تعزيز سلطاته التحقيقية والإجرائية وفتح مجالات جديدة لإيلاجها ومنها حماية البيئة وممارسة الشعائر الدينية وحماية الصحة العمومية والدفع بعدم دستورية القوانين كقاضي تصفية. Both the ordinary judge and the administrative judge have great importance in protecting basic rights and freedoms within society, but the administrative judge has a more effective role because it works to maintain the necessary balance between protecting individuals from the abuse of administration and protecting public order within society, by expanding the scope of the administrative judge’s intervention. And empowering him with stronger powers, so that he intervenes systematically and quickly by strengthening his investigative and procedural powers and opening new areas for their penetration, including protecting the environment, practicing religious rites, protecting public health, and advocating the unconstitutionality of laws as a liquidation judge.
