الضوابط القانونية للتدخلات الطبية الحديثة الواردة على جسم الإنسان (عمليات نزع وزرع الأعضاء البشرية بين الأحياء نموذجا)

الملخص
يعتبر مبدأ حرمة جسم الإنسان والتكامل الجسدي وعدم جواز المساس به، حقا دستوريا، غير أنه يرد عليه استثناء يتعلق بجواز المساس بجسم الإنسان للضرورة العلاجية، متى توافرت المبادئ البيو –أخلاقيات الطبية التي نذكر أهمها: - مبدأ عدم جواز التعامل المالي بجسم الإنسان، - مبدأ عدم جواز الكشف عن السر الطبي، -ضرورة احترام السلامة الجسدية للمريض، - ضرورة الحصول على ترخيص مسبق لمزاولة مهنة الطب، -وصدور ترخيص مسبق للمستشفيات التي تجري عمليات متخصصة كنزع وزرع الأعضاء البشرية. إضافة إلى ذلك، من الضروري صدور رضا المريض وموافقته المسبقة والمستنيرة والمتبصّرة والحرّة لإجراء العلاج الطبي، وذلك بعد تنفيذ الطبيب التزامه بإعلام المريض وتبصيره وفقا للقانون والأصول العملية والعلمية للعمل الطبي. The principle of the inviolability of the human body, and the principle of physical integrity is a constitutional right, However, an exception is made with regard to the infringement of the human body of a therapeutic necessity, when the principles of bioethics are respected, the most important of which are: - Principle of inadmissibility of financial interaction with the human body - Principle of non-disclosure of medical confidentiality- The need to respect the physical integrity of the patient - The need to obtain a prior licence to practise the medical profession and the prior authorization of hospitals to conducting specialized operations such as removal and transplantation of human organs. In addition, it is necessary to issue the patient's consent and prior, informed, visionary and free consent for medical treatment, after the doctor has implemented his obligation to inform the patient in accordance with the law and the principles of the of the medical practice.
