الملخص
أجاز المشرع الجزائري نزع الأعضاء البشرية من جثث الموتى بمقتضى قانون 18-11 المتعلق بالصحة، تحت تأثير النقص الحاد الذي تعاني مته الجزائر في التبرع بالأعضاء البشرية من طرف الأحياء، نظرا لأهميتها في المحافظة على الصحة العامة، وما تشكله من توثيق لأواصر التضامن والتكافل الاجتماعي من جهة، وما قد ينجر عنها من خرق لمبدأ حرمة الجثة الآدمية، وجعلها محلا لأطماع عصابات الإتجار بالأعضاء البشرية من جهة أخرى، وتأتي هذه الورقة البحثية كمحاولة للبحث عن مدى فعالية النصوص القانونية المنظمة لعمليات نزع وزرع الأعضاء البشرية في توفير حماية قانونية للجثة الآدمية. The Algerian legislator permitted the removal of human organs from the dead bodies in accordance with Law 11-18 related to health, under the influence of the severe shortage that Algeria suffers from in the donation of human organs by the living, given first in their importance in maintaining public health, and the consolidation of the bonds of solidarity and social solidarity, and second what may result from it in violation of the principle of the sanctity of the human corpse, and making it an object of ambition for human organ trafficking gangs, this research paper comes as an attempt to search for the effectiveness of the framework regulating the removal and transplantation of human organs in providing adequate legal protection for the human corpse
