المثول الفوري اجراء بديل للمتابعة في التلبس بالجنح في التشريع الجزائري

الملخص
تبنى المشرع الجزائري في تعديل قانون الاجراءات الجزائية لسنة 2015، اجراء المثول الفوري كبديل لنظام التلبس بالجنح، بهدف تبسيط وتسريع اجراءات المتابعة الجزائية في بعض الجنح التي لا تستدعي تحقيقا، ويخضع هذا الاجراء الى مجموعة من الشروط الشكلية والموضوعية والاجراءات المتفردة قبل واثناء المحاكمة. وتسعى هذه الدراسة؛ الى التعريف بالأحكام القانونية والاجرائية للمثول الفوري في التشريع الجزائري، وبيان شروطه وضوابطه، ويعمل هذا الاجراء على تجريد وكيل الجمهورية من سلطة الايداع رهن الحبس المؤقت باعتباره خصما في الدعوى ويخول هذه الصلاحية للقاضي فقط، كما انه مكّن المتهم لأول مرة في الجزائر من الاتصال بمحاميه داخل اروقة المحكمة قبل الجلسة في مكان خاص.
