ترميم المعالم الأثرية في التشريع الجزائري

الملخص
ملخص: يهدف البحث في موضوع ترميم المعالم الأثرية إلى بيان أهميتها في الحفاظ على أصالة المجتمعات و الأمم من خلال ربط مقوماتها الضاربة في عمق التاريخ بحاضرها و مستقبلها، و ترسيخ قيمها و هويتها للأجيال الصاعدة، خاصة إذا و أن العملية تستهدف أقوى تلك الشواهد إيحاءً المتمثلة في الإرث المعماري الثقافي، و بالنظر لهذه الأهمية يستدعي منا البحث في إشكالية الإطار القانوني لها و آلياته التنفيذية في التشريع الجزائري، بحيث يتم الاجابة عن ذلك من خلال تحديد الطبيعة القانونية لعملية الترميم بوصفها تنبني على اعتبارات فنية بالدرجة الأولى، ثم بيان الآليات القانونية لها سواء المتعلقة بالجانب التقني المتعلقة بمخطط الترميم الذي يكتسي طابعا استشاريا من مختلف الفاعلين المختصين، أو الجانب المالي الذي تحكم فيه الهدف من أشغال الترميم. تم نختتم الدراسة بتقييم مدى فاعلية ترميم التراث المعماري الأثري، في بلوغ الأهداف المسطرة اجتماعيا و اقتصاديا. Abstract: The aim of researching the restoration of archaeological landmarks topic is to show its significance in maintaining the authenticity of societies and nations, by linking its components deeply in history with its present and future. It consolidates its values and identity for the coming generations. Especially, when the process targets the strongest suggestive evidences represented in cultural architectural heritage. Considering this significance, it is necessary to conduct research in a legal framework and its executive mechanisms in the Algerian legislation. So, it is answered by determining the legal nature of the restoration process, As It is based on technical considerations in the first place. Then showing its legal mechanisms, whether related to a technical aspect related to a restoration scheme, which has an advisory stamp from different specialists, or the financial aspect that got governed by the purpose. The study was concluded by evaluating the effectiveness of restoring archaeological architectural heritage and achieving social and economic goals..
