حدود إلتزام البنوك بالسرية المصرفية

الملخص
يعد الالتزام بالسرية المصرفية من أهم وأشد الالتزامات التي تقع على عاتق البنوك وتأتي أهمية هذا الالتزام استنادا إلى حماية خصوصية العميل وحماية مصلحة المصرف وحماية المصالح الاقتصادية للدولة، ويسبب إفشاء السر المصرفي أضرارا جسيمة تلحق بصاحبها وتزعزع ثقته بعمل البنوك، لهذا أوجبت التشريعات القانونية على البنوك الالتزام بالسرية المصرفية تحت طائلة العقوبات الجزائية، غير أن السرية المصرفية لا يمكن أن تكون مطلقة لأنها قد تشكل عائقا أمام العدالة بالنظر لاستعمالها كوسيلة لتهريب الأموال وتبييضها والاحتيال على القوانين الضريبية وغيرها، لهذا عمد المشرع على وضع بعض الاستثناءات تمثل حدودا لهذا المبدأ، فرضت حماية للنظام العام والمصلحة العامة وكذلك حماية لبعض المصالح الخاصة للأفراد، بالمقابل لا يجب أن يتحول الاستثناء إلى قاعدة من خلال الإفراط في الاستثناءات لأن الإفشاء يضر بمصلحة العميل ومصلحة البنك. Abstract: Commitment to banking secrecy is one of the most important and strongest obligations that banks have, the importance of this commitment is based on protecting the customer’s privacy, The protection of the interest of the bank and protecting the economic interests of the state. Disclosure of the banking secret causes serious damage to its owner and undermines his confidence in the banks work. Therefore, the legal legislation requires banks to adhere to banking secrecy under penal sanctions. However, banking secrecy cannot be absolute because it may constitute an obstacle to justice given its use as a means of smuggling and laundering money and defrauding tax laws and others, that is why the legislator has set some exceptions that represents limits to this principle, imposed to protect public order and the public interest, as well as to protect some private interests of individuals. On the other hand, the exception should not turn into a rule through excessive exceptions because disclosure harms the interest of the customer and the bank's interest
