الملخص
ملخص: إن تحميل القادة المسؤولية الدولية الجنائية جراء ارتكابهم جرائم دولية، يتطلب أساسا قانونيا في القانون الدولي يمكن من خلاله الإدعاء بمسؤولية مرتكبي الجرائم الدولية، وإذا كان هذا الأمر قد حسم بالنسبة لمسؤولية القادة النظاميين سواء كانوا عسكريين أو مدنيين، فإنه لا يزال يشكل عائقا أمام الإقرار بمسؤولية القادة غير النظاميين المسيطرين على الجماعات المسلحة غير الحكومية، ويرجع ذلك للغموض الذي يكتنف مسألة شرعية المقاتلين التابعين للجماعات المسلحة غير الحكومية والوضع القانوني لهؤلاء المقاتلين من جهة، ومسألة إمكانية خضوع أعضاء الجماعات المسلحة غير الحكومية للقواعد والمبادئ التي تفرضها قوانين الحرب وأحكامها، هذا ما تحاول هذه المقالة دراسته اعتمادا على ما ترسخ من مبادئ القانون الدولي الجنائي. Abstract: Holding the international criminal responsibility of commanders and chiefs for committing international crimes requires a legal basis in international law, through which the responsibility of the perpetrators of international crimes can be claimed. Recognizing the responsibility of the irregular leaders who control non-state armed groups, due to the ambiguity surrounding the issue of the legality of combatants of non-state armed groups and the legal status of these fighters on the one hand, and the question of the possibility for members of non-state armed groups to be subject to the rules and principles imposed by the laws and provisions of war on the other hand, this is what This article attempts to study it, based on the established principles of international criminal law.
