الضمانات القانونية لتمكين المكتتب من السكن في عقد البيع على التصاميم Legal Guarantees To Allow The Buyer To Acquire His Apartment In The Sale Contract On Design

الملخص
ملخص: تناولت هذه الدراسة أهم الضمانات القانونية الواردة في قانون الترقية العقارية و التي من شأنها حماية المكتتب في عقد البيع على التصاميم و ضمان حصوله على سكنه، بإعتبار أن محل عقد البيع غير موجود وقت التعاقد مما يعرضه للعديد من المخاطر. أولى هذه الضمانات تتعلق بصفة منجز البناية، حيث يشترط أن يكون مرقيا عقاريا نظرا لما يتطلبه إكتساب هذه الصفة من شروط و ما يترتب عليها من مسؤولية حمايةً للمكتتب، و في حال إخلال المرقي العقاري بالتزاماته التعاقدية يضمن صندوق الضمان و الكفالة المتبادلة إسترداد التسبيقات أو إتمام الإنجاز. و ثاني الضمانات، التزام المرقي العقاري نقل الملكية و تسليم البناية إلى المكتتب. Abstract: This study dealt with the most important guarantees included in the real-estate promotion law wich protect the buyer in the sale contract on design and ensure that he gets his housing, this is due to the fact that the housing is not available at the time of contracting ,which exposes the buyer to many risks. The first of these guarantees pertains to the completion of the building’s construction, where it is required that the real estate promoter is qualified and compliant with the the conditions associated with acquiring this status to ensure the protection of the buyer.in case of the real estate promoter’s failure to fulfill its contractual obligations, the guarantee and mutual insurance fund ensures the completion of the construction or to compensate the buyers.the second guarantee is the promoter’s commitment to transfer ownership and deliver the building to the buyer.
