فكرة العقود الذكية كأحد أهم تطبيقات البلوك تشين

الملخص
التحولات التكنولوجية والرقمية التي تشهدها الساحة القانونية ألقت بظلالها على مختلف التعاملات لا سيما مؤسسة العقد، حيث ظهر نمط تعاقدي جديد فيما أصبح يسمى بالعقود الذكية والتي تعتمد على تكنولوجيا سلسلة الكتل أو البلوك تشين، وتتجسد في استخدام برامج خوارزمية مشفرة غير مقروءة تمثل شروط و أحكام العقد التي تجري بين شخصين أو أكثر دون التدخل من وسيط أو طرف ثالث تجعل من تطبيقها أكثر سهولة من خلال أتمتة مراحل التعاقد لاسيما تنفيذه، وترفع من الأمن التعاقدي بحيث لا يتم تعديل أو تحريف أو اتلاف المعطيات، وبالتالي يمكن أن تكون العملية بأكملها بديلا للعقود الورقية. إن العقود الذكية في حد ذاتها لست جديدة ولكنها وجدت في تقنية البلوك تشين ديناميكية ولاقت رواجا كبيرا وقد تم الاعتراف بها في عدة دول كأمريكا وفرنسا ودولة الامارات العربية، ولكنها لازلت غريبة عن التشريع الجزائري وعليه يجدر التساؤل عن مدى استيعاب النظرية العامة للعقد لخصوصية هذه العقود والتحديات التي تواجه تأطيرها، لاسيما في ظل عدم وجود قانون خاص يحكمها أو حتى ينظم عمل البلوك تشين. abstract: Technological and digital transformations taking place in the legal arena have cast a shadow over various transactions, especially the contract institution, where a new contractual pattern has emerged in what has become called smart contracts based on blockchain technology or blue chain, and is embodied in the use of unread encrypted algorithm programs that represent the terms and conditions of the contract between two or more persons without the intervention of a intermediary or third party that makes their application easier by automating the stages of the contract, especially its implementation, and it increases the contractual security so that the data is not modified, distorted or destroyed. smart contracts in themselves are not new, but they have been found in blockchain technology to be dynamic and have been recognized in several countries such as America, France and the United Arab Emirates, but they are still alien to Algerian legislation, so it is therefore worth asking the extent to which the general theory of the contract accommodates the specifity of these contracts and the challenges facing framing them, Especially in the absence of a special law governing it or even regulating the work of blockchain.
